NOTICE OF PUBLIC HEARING TO REVIEW SPECIAL ASSESSMENT ROLL

CEDAR LAKE

TO ALL RECORD OWNERS OF OR PERSONS OF INTEREST IN PROPERTY WITHIN THE CEDAR LAKE LEVEL SPECIAL ASSESSMENT DISTRICT:

 

TAKE NOTICE that a special assessment roll has been prepared and is on file for public examination at the offices of the Iosco and Alcona County Drain Commissioners for public examination during ordinary business hours. The Iosco County Drain Commissioner’s office is located at 420 W. Lake Street, Tawas City, MI 48763. The Alcona County Drain Commissioner’s office is located at 301 N. Lake Street (PO Box 40), Lincoln, MI 48742. Please visit your County Drain Commissioner’s Office to inspect the roll. The special assessment roll has been prepared for assessing the cost of maintaining the established lake level for Cedar Lake as permitted under MCL 324.30712.

TAKE FURTHER NOTICE that on Tuesday, November 12, 2019, the Iosco and Alcona County Drain Commissioners, as the delegated authorities of the Cedar Lake Level District, will hold a public hearing at the Greenbush Township Hall, 5039 Campbell Street, Greenbush, MI 48738 at 10:00 A.M., for the purpose of reviewing said special assessment roll, hearing any objections hereto, and making a determination whether to approve the roll. The hearing may be adjourned from time-to-time without further notice. 

TAKE FURTHER NOTICE that appearance and protest at the hearing is required in order to appeal the amount of the special assessment. Any person or local unit of government objecting to the assessment roll shall: (1) appear at the above stated time and place and/or file their objection in writing with the Iosco or Alcona Drain Commissioner by no later than the close of the hearing; or (2) file an appearance and protest by letter addressed to the Iosco or Alcona Drain Commissioner (using the mailing addresses above) that, if received no later than the date of hearing, will not require a personal appearance at the hearing. The Cedar Lake Level District shall maintain a record of parties who appear to protest at the hearing.  If the hearing is terminated or adjourned before a party is provided the opportunity to be heard, a party whose appearance was recorded shall be considered to have protested the special assessment in person. Please address all correspondence to the Drain Commissioner of the county in which your property is located.     

Proceedings conducted at this public hearing will be subject to the provisions of the Michigan Open Meetings Act and you are further notified that information regarding this meeting may be obtained from the Iosco or Alcona County Drain Commissioners’ Offices at (989) 252-7328. Persons with disabilities needing accommodations for effective participation in the meeting should call (989) 252-7328 or use the Michigan Relay Center at 7-1-1 (TDD) at least 24 hours in advance of the meeting to request mobility, visual, hearing or other assistance.  Minutes of the meeting will be on file in the Iosco and Alcona County Drain Commissioners’ Offices.

The special assessment roll shall be final and conclusive unless appealed within fifteen (15) days following county board approval. MCL 324.30714.

Meetings are held on the 2nd and 4th Wednesday of each month at 4:00pm at the Road Commission office, unless otherwise noted. Meetings are open to the public. All inquires must be put in writing prior to addressing the board.
